A LegalBens answer

The conclusion, and the article behind it.

Ask your question in English, French, Arabic or Darija: the answer follows your language and quotes the law as it is published, in Arabic or French, the Arabic text being authoritative. The law itself is never translated.

Example analysis

Question

My employer refuses to give me my employment certificate. How long do they have?

Conclusion

Eight days at most.

When the contract ends, the employer must hand over the employment certificate within eight days at most, or be liable for damages.

Ask for it in writing, citing Article 72 of the Labour Code.

Labour Code · Law No. 65-99Article 72

French version

« L'employeur doit délivrer au salarié un certificat de travail, à la cessation du contrat de travail, dans un délai maximum de huit jours, sous peine de dommages-intérêts. »

Arabic version, authoritative

«يجب على المشغل، عند انتهاء عقد الشغل، تحت طائلة أداء تعويض، أن يسلم الأجير شهادة شغل داخل أجل أقصاه ثمانية أيام.»

Our method

Four checks, before every answer.

Finding the article is not enough. You also need its wording in force, its exceptions, the authoritative version and how certain each source is. No answer reaches you without passing these checks.

  1. The applicable version

Laws change. LegalBens applies the wording in force on the date of the facts, never an outdated one.

    1. Previous wordingreplaced
    2. Wording in forceapplied
  2. Exceptions and conditions

Before concluding, LegalBens looks for anything that could bend the rule: a derogation, a condition, a special law.

Rent review for a home: 8% at most, and not before three years.

Derogation: when the rent does not exceed 400 dirhams a month, the court sets the increase, up to 50%.

    Law No. 07-03, articles 2 to 5

  3. The authoritative text

The Arabic version published in the Official Bulletin is authoritative. When the French translation departs from it, LegalBens tells you so explicitly.

The French version of this article does not carry the same amounts as the Arabic version, which is authoritative: check the Arabic text before acting.

  4. How certain it is

Every source is labelled: official text, reviewed by a lawyer, or to be checked. When information is missing, LegalBens says so, or asks you.

    • Verified by a lawyer
    • Official text, not yet reviewed by a lawyer
    • Unofficial translation, to be checked

In practice

Each space, tested on a real case.

Three situations, three documents: what LegalBens produces for you, with the article to back it.

Individuals

Your situation, analysed like a case file.

A dismissal, a lease, a disputed purchase, an administrative formality: LegalBens opens a case file, identifies the applicable texts, calculates your deadlines and shows you what to do next.

If your situation calls for it, it prepares the hand-over to a lawyer. Nothing is shared without your consent.
